सुप्रीम कोर्ट ने गुरुवार को केंद्र सरकार की चुनावी बॉन्ड योजना की कानूनी वैधता को चुनौती देने वाली याचिकाओं पर सर्वसम्मति से फैसला सुनाया, जो राजनीतिक दलों को गुमनाम फंडिंग की अनुमति देती है। भारत के मुख्य न्यायाधीश डीवाई चंद्रचूड़ ने कहा कि दो अलग-अलग फैसले थे – एक उनके द्वारा लिखा गया और दूसरा न्यायमूर्ति संजीव खन्ना द्वारा और दोनों फैसले सर्वसम्मत थे।

शीर्ष अदालत ने गुमनाम चुनावी बांड योजना को अनुच्छेद 19(1)(ए) के तहत सूचना के अधिकार का उल्लंघन मानते हुए कहा कि राजनीतिक दल चुनावी प्रक्रिया में प्रासंगिक इकाइयां हैं और चुनावी विकल्पों के लिए राजनीतिक दलों की फंडिंग के बारे में जानकारी आवश्यक है।

सुप्रीम कोर्ट ने आगे कहा कि काले धन पर अंकुश लगाने के लिए सूचना के अधिकार का उल्लंघन उचित नहीं है। चुनावी बांड के माध्यम से कॉर्पोरेट योगदानकर्ताओं के बारे में जानकारी का खुलासा किया जाना चाहिए क्योंकि कंपनियों द्वारा दान पूरी तरह से बदले के उद्देश्यों के लिए है।

सुप्रीम कोर्ट ने इस योजना को असंवैधानिक करार देते हुए कहा कि चुनावी बांड योजना को रद्द करना होगा।

चुनावी बांड योजना क्या है ?
चुनावी बांड योजना को केंद्र सरकार द्वारा 2 जनवरी, 2018 को अधिसूचित किया गया था। यह योजना भारत में कंपनियों और व्यक्तियों को गुमनाम रूप से राजनीतिक दलों को दान देने में सक्षम बनाती है।

इस योजना का यह कहते हुए बचाव किया गया कि राजनीतिक दान में गुमनामी यह सुनिश्चित करने के लिए आवश्यक है कि अन्य राजनीतिक दलों से प्रतिशोध की कोई आशंका न हो।

यह भी तर्क दिया गया कि चुनावी बांड योजना उचित बैंकिंग चैनलों के माध्यम से राजनीतिक फंडिंग के लिए ‘सफेद’ धन का उपयोग सुनिश्चित करेगी।
